為保障客戶與OULU CLOUD的相互權利和義務,我方會在購買產品時提示本服務條款,無論用戶是否認真查看本條款,購買產品和服務即視為默認同意此服務條款與內容。
【簽約動作】當您閱讀並點擊同意本協議或以其他方式選擇接受本協議後,即表示您已充分閱讀、理解並接受本協議的全部內容,並與歐路雲達成一致。本協議自您通過網絡頁面點擊確認或以其他方式選擇接受本協議之日起成立。閱讀本協議的過程中,如果您不同意本協議或其中任何條款約定,請勿進行簽約動作。 即註冊賬戶之日起!如因產生任何糾紛矛盾OULU CLOUD不承擔條款之外的責任壹律用戶自行承擔、或對OULU CLOUD 「服務條款」 中不明確的,可咨詢客服了解詳情、和有利與您在OULU CLOUD消費權益保障。
1、 Overview of Service Terms
In order to protect the mutual rights and obligations of customers and OULU CLOUD, we will remind you of these service terms when purchasing the product. Regardless of whether the user carefully reviews these terms or not, purchasing the product and service will be deemed as default agreement to these service terms and contents.

This agreement shall be effective from the date you click to confirm or choose to accept it through other means on the online page. 二、用戶信息及隱私保護
- 用戶是指具有完全民事能力的自然人、法人和組織等。
- 用戶需要向本網站提供其真實、準確、完整的用戶信息;當相應信息發生變化時,用戶需要及時更新相應信息,以維護其用戶信息的有效性。
- 用戶需要妥善保管其用戶賬號,並對該賬號進行的所有活動和事件承擔全部責任。
- 用戶同意並授權:基於產品和服務的重要性,OULU CLOUD通過其提供的用戶信息,包括但不限於郵件、即時通訊等方式,保持與客戶間的聯絡、溝通及緊急事件處理等。
- 任何在本網站所提交的用戶信息,僅限用於我們為用戶提供更高效的優質服務體驗。
- OULU CLOUD承諾並保障為用戶信息及客戶隱私進行保密,並在必要時銷毀數據。
2、 User information and privacy protection
- Users refer to natural persons, legal persons, and organizations with full civil capacity.
- Users need to provide their true, accurate, and complete user information to this website; When the corresponding information changes, users need to update it in a timely manner to maintain the effectiveness of their user information.
- Users need to properly keep their user account and take full responsibility for all activities and events carried out by that account.
- User agrees and authorizes: Based on the importance of the product and service, OULU CLOUD maintains contact, communication, and emergency response with customers through the user information provided by OULU CLOUD, including but not limited to email, instant messaging, and other means.
- Any user information submitted on this website is limited to providing users with a more efficient and high-quality service experience.
- OULU CLOUD promises and guarantees the confidentiality of user information and customer privacy, and destroys data when necessary.
三、數據保障
- 由於計算機硬盤及存儲設備屬於電子設備,即使在硬件RAID10的環境下,也無法保證100%不出現任何故障。故用戶有義務負責其自身的數據安全,我們強烈建議用戶定期進行數據備份工作;
- 由於硬件故障或客戶濫用導致的數據丟失,OULU CLOUD不承擔其賠償責任,但我們將全力協助客戶恢復數據及解決問題。如果由於我方工作人員操作失誤及其他原因造成的客戶數據丟失,我們將積極地與用戶協商、恢復數據,並視具體情況為用戶提供滿意的處理方案。
- 用戶需要妥善保管其用戶賬號,並對該賬號進行的所有活動和事件承擔全部責任。
3、 Data Assurance
- Due to the fact that computer hard drives and storage devices belong to electronic devices, even in a hardware RAID10 environment, it cannot be guaranteed to be 100% faultless. Therefore, users are responsible for their own data security, and we strongly recommend that users regularly backup their data;
- OULU CLOUD shall not be liable for compensation for data loss caused by hardware failures or customer abuse, but we will fully assist customers in recovering data and resolving issues. If customer data is lost due to operational errors or other reasons by our staff, we will actively negotiate with the user to recover the data, and provide satisfactory solutions to the user based on the specific situation.
- Users need to properly keep their user account and take full responsibility for all activities and events carried out by that account.
四、終止服務
- 如果您沒有按時支付費用,您帳戶的訂單將被暫停或刪除。
- 產品壹旦到期,您的賬戶將被暫停或刪除,我方有權在不通知客戶的情況下刪除服務數據,由此產生的數據丟失我方不承擔任何責任。
- 在賬單逾期超過3天,我們將收取壹定比例的滯納金。賬單逾期超過5天未付款,您的賬戶將被徹底刪除,由此產生的數據丟失我們不負任何責任。
- 因用戶欠費、不續費或者遺忘續費導致的服務無法訪問(使用)或數據丟失等我方不承擔任何責任。
- 任何非因我方原因造成的服務終止,在備份數據可用的情況下,可以有償恢復您的數據賬戶。
- 如果您違反了「服務條款」以及「可接受的使用條款」, OULU CLOUD有權終止服務;
- 涉及退款的服務OULU CLOUD有權不通知直接終止;
4、 Termination of Service
- If you fail to pay the fees on time, your account's orders will be suspended or deleted.
- Once the product expires, your account will be suspended or deleted. We have the right to delete service data without notifying the customer, and we will not be responsible for any data loss caused by this.
- If the bill is overdue for more than 3 days, we will charge a certain proportion of late fee. If the bill is overdue for more than 5 days without payment, your account will be completely deleted, and we are not responsible for any data loss caused by this.
- We do not assume any responsibility for services that cannot be accessed (used) or data loss caused by users' arrears, non renewal, or forgetting to renew.
- If any service termination is not caused by our reasons, you can recover your data account for a fee provided that backup data is available.
- If you violate the "Terms of Service" and "Acceptable Terms of Use", OULU CLOUD has the right to terminate the service;
- The service OULU CLOUD that involves refunds has the right to terminate it directly without notice;
五、補償及賠償條款
- 因我方原因造成的宕機、數據丟失等,客戶有權要求OULU CLOUD進行相應補償或賠償,最大賠償金額不超過此設備租用壹個月的租憑費用,不限於以下行為:
- 因我方工作人員操作失誤造成的宕機,但數據中心設備維護、網絡設備升級等不屬於賠償的範疇;
- 因我方原因與責任造成的客戶數據丟失;
- 因政治變動、戰爭等社會事件及天氣、地震等自然守災害等不可抗力因素造成的任何事件,OULU CLOUD不提供任何補償和賠償;
- 因違反本服務條款的規定造成的用戶損失和影響,OULU CLOUD不提供任何補償和賠償。
5、 Compensation and Compensation Clause
- The customer has the right to demand corresponding compensation or compensation from OULU CLOUD for downtime, data loss, etc. caused by our own reasons. The maximum compensation amount shall not exceed the rental fee for one month of renting this equipment, and shall not be limited to the following behaviors:
- Downtime caused by operational errors by our staff, but data center equipment maintenance, network equipment upgrades, etc. are not within the scope of compensation;
- Customer data loss caused by our own reasons and responsibilities;
- OULU CLOUD shall not provide any compensation or compensation for any events caused by political changes, social events such as war, and force majeure factors such as weather and earthquakes;
- OULU CLOUD does not provide any compensation or compensation for user losses and impacts caused by violating the provisions of these service terms.
六、欠費處理
- 用戶需要提前至少2天辦理業務續費,在業務到期時,客戶的業務將面臨暫停服務、業務取消、數據丟失的風險,OULU CLOUD不承擔客戶未及時辦理繳費下導致的用戶損失。
- 支付賬單後如因第三方網關回傳數據未成功,應通過工單通知客戶進行手動入賬.
6、 Arrears processing
- Users need to apply for business renewal at least 2 days in advance. When the business expires, the customer's business will face the risk of service suspension, business cancellation, and data loss. OULU CLOUD will not be responsible for any user losses caused by the customer's failure to pay in a timely manner.
- If the data returned by the third-party gateway is not successful after paying the bill, the customer should be notified through a work order to manually enter the account
七、取消服務請求
- 取消服務不等同於退款服務, 取消請求是指提前或到期後該訂單的產品將終止續費功能.
- 已提交取消服務請求需要恢復正常續費使用的,可通過工單聯系客服人員撤銷請求.
- 提交取消服務後已推送的賬單將自動取消, 如賬單已有支付的情況可通過工單向客服人員索取退回余額賬戶.
7、Cancell Request
- Canceling a service is not equivalent to a refund service. A cancellation request refers to the termination of the renewal function for the product of the order in advance or after its expiration
- If a service cancellation request has been submitted and normal renewal usage needs to be restored, the request can be revoked by contacting customer service personnel through a work order
- After submitting the cancellation service, the pushed bill will be automatically cancelled. If the bill has already been paid, the balance account can be refunded to the customer service personnel through the hotline
八、優惠與價格調整
基於市場及產品的變化,及活動推廣的需要,OULU CLOUD將不定期地推出各類優惠,也包括適當的價格調整。OULU CLOUD保留進行優惠和調整價格的全部權利。產品價格發生變動時,僅適用於新訂單,無法應用於已有訂單及現有業務。OULU CLOUD保留隨時修改服務體系、價格而不需通知用戶的權利。
8、 Discounts and price adjustments
Based on changes in the market and products, as well as the needs of event promotion, OULU CLOUD will periodically launch various discounts, including appropriate price adjustments. OULU CLOUD reserves all rights to discounts and price adjustments. When there is a change in product price, it only applies to new orders and cannot be applied to existing orders or existing businesses. OULU CLOUD reserves the right to modify the service system and prices at any time without notifying users.
九、惡意攻擊及詆毀
- 我們的服務團隊將秉承為客戶解決全部問題,服務至上的原則為用戶提供服務,如我們的工作人員有任何違反的,請及時郵件聯系我們suppor@oulucloud.com進行投訴及舉報,OULU CLOUD將視情況給予合理的處理及反饋。
- 用戶在言語及行為上數次惡意攻擊OULU CLOUD工作人員和詆毀OULU CLOUD聲譽的,包括但不限於非法的、騷擾的、中傷他人的、辱罵性的、恐嚇性的、傷害性的、詆毀性的言行時,我們有權暫停該用戶的相應服務及終止向該用戶提供服務且不退款。並保留追究其法律責任的權利。
- 交流過程中,道德綁架、人身攻擊、惡言相向、辱罵、侮辱客服人員的將剝奪用戶所有權利,在提交致歉書和手持身份證視頻道歉聲明以及消除不良影響後可重新協商恢復。
9、 Malicious attacks and defamation
- Our service team will adhere to the principle of solving all problems for customers and putting service first to provide services to users. If any of our staff violates this, please contact us via email in a timely manner suppor@oulucloud.com For complaints and reports, OULU CLOUD will provide reasonable handling and feedback based on the situation.
- When a user maliciously attacks OULU CLOUD staff and defames OULU CLOUD's reputation multiple times in terms of language and behavior, including but not limited to illegal, harassing, defamatory, abusive, intimidating, hurtful, and defamatory words and actions, we have the right to suspend the corresponding services of the user and terminate the service provided to the user without a refund. And reserve the right to pursue their legal responsibilities.
- During the communication process, moral kidnapping, personal attacks, verbal attacks, insults, or insults to customer service personnel will deprive users of all rights. After submitting an apology letter and holding an ID card video apology statement, as well as eliminating adverse effects, they can be renegotiated for recovery.
十、退款服務(Refund Service)
自購買虛擬服務器之日算按照合理理由申請退款服務,退款不包含產品套餐外的其他附加產品或服務,如cPanel、DirectAdmin等商業軟件以IP的授權費和購置費,
如下情況除外之壹無退款:
- 牽涉違反本服務條款的行為;
- 產品開通之日起不超過購買周期的50% 可按天退款。(開通不滿一天按照一天計算 以此類推);
- 產品開通日起已超過購買周期的50%無退款;
- 附加服務無法獲得退款,如消費時有額外贈品,且贈品無法退費(如域名),需扣除贈品費用後退款;
- 非OULU CLOUD自身原因;
- 惡意試用,已經有多次 退款記錄不提供退款;
- 有交惡或爭議未解決之前不提供退款;
- 物理設備,服務器租用以及機櫃托管業務無退款服務。
- IP在使用過程中被GFW屏蔽,無退款!

附二:退款條款相關、指在系統後臺自動刪除主機、系統自動扣除費用、所退款默認退到帳戶余額、用戶可以選擇繼續消費、金額不可原路返回
10、 Refund Service
Within three days from the date of purchase of the virtual server, you can apply for a refund service based on reasonable reasons. The refund does not include other additional products or services other than the product package, such as the license fee and purchase fee for cPanel, DirectAdmin and other commercial software and IP,
There is no refund except for one of the following situations:
- Involved in violations of these service terms;
- From the date of product launch, refunds can be made on a daily basis up to 50% of the purchase cycle. (Less than one day after opening will be calculated as one day and so on);
- 50% of the purchase cycle has exceeded since the product's opening date, and there is no refund;
- Additional services cannot be refunded. If there are additional gifts during consumption and the gift cannot be refunded (such as domain names), the refund must be made after deducting the gift fee;
- Not due to OULU CLOUD's own reasons;
- Malicious trial, there have been multiple refund records that do not provide refunds;
- Refunds will not be provided until there is a conflict or dispute resolved;
- There is no refund service for physical equipment, server rental and cabinet hosting business.
- IP is blocked by GFW during use, no refund!

十壹、違約責任(Liability for breach of contract)
本條款在免責條款及其他用戶過錯或不可抗力因素除外。
用戶單獨承擔發布內容的責任。用戶對服務的使用是根據所有適用於服務的地方法律、國家法律和國際法律標準的。用戶承諾:
(一).在oulucloud計算服務的網頁上發布信息或者利用Oulu Cloud計算服務的服務時必須符合中國有關法規,不得在Oulu Cloud計算服務的網頁上或者利用Oulu Cloud計算服務的服務製作、復製、發布、傳播以下信息:
- 反對憲法所確定的基本原則的;
- 危害國家安全,泄露國家秘密,顛覆國家政權,破壞國家統一的;
- 損害國家榮譽和利益的;
- 煽動民族仇恨、民族歧視,破壞民族團結的;
- 破壞國家宗教政策,宣揚邪教和封建迷信的;
- 散布謠言,擾亂社會秩序,破壞社會穩定的;
- 散布淫穢、色情、賭博、暴力、兇殺、恐怖或者教唆犯罪的;
- 侮辱或者誹謗他人,侵害他人合法權益的;
- 含有法律、行政法規禁止的其他內容的。
(二).在Oulu Cloud計算服務的網頁上發布信息或者利用Oulu Cloud計算服務的服務時還必須符合其他有關國家和地區的法律規定以及國際法的有關規定。
(三).不利用Oulu Cloud計算服務的服務從事以下活動:
- 未經允許,進入計算機信息網絡或者使用計算機信息網絡資源的;
- 未經允許,對計算機信息網絡功能進行刪除、修改或者增加的;
- 未經允許,對進入計算機信息網絡中存儲、處理或者傳輸的數據和應用程序進行刪除、修改或者增加的;
- 故意製作、傳播計算機病毒等破壞性程序的;
- 其他危害計算機信息網絡安全的行為。
- 不以任何方式幹擾Oulu Cloud計算服務的服務。
- 遵守Oulu Cloud計算服務的所有其他規定和程序。
- IP 投訴/濫用運營商將收取每次$20 的罰款!(由用戶自行承擔)
用戶需對自己在使用Oulu Cloud計算服務服務過程中的行為承擔法律責任。用戶理解,如果Oulu Cloud計算服務、發現其網站傳輸的信息明顯屬於上段第1條所列內容 之一,依據中國香港法律,中國法律,服務器所在國法律,Oulu Cloud計算服務有義務立即停止傳輸,保存有關記錄,向國家有關機關報告,並且刪除含有該內容的地址、目錄或關閉服務器。用戶若違反OULU CLOUD[可接受使用條款AUP]規定的,OULU CLOUD有權直接刪除用戶的所有資料,並且不提供任何形式的備份和補償。
11. Liability for breach of contract
This clause is exclusive of the exemption clause and other user fault or force majeure factors.
Users are solely responsible for publishing content. User's use of the Service is in accordance with all local, national and international legal standards applicable to the Service. User commitment:(1) When publishing information on the webpage of Oulu Cloud computing services or utilizing Oulu Cloud computing services, it must comply with relevant Chinese regulations and shall not create, copy, publish, or disseminate the following information on the webpage of Oulu Cloud computing services or utilizing Oulu Cloud computing services:
- Opposing the basic principles established by the Constitution;
- Those who endanger national security, leak national secrets, subvert national power, and undermine national unity;
- Harming national honor and interests;
- Inciting ethnic hatred, discrimination, and undermining ethnic unity;
- Disrupting national religious policies, promoting cults and feudal superstitions;
- Spreading rumors, disrupting social order, and disrupting social stability;
- Spreading obscenity, pornography, gambling, violence, murder, terror, or instigating crimes;
- Insulting or defaming others, infringing on their legitimate rights and interests;
- Containing other content prohibited by laws and administrative regulations.
(2) When publishing information on the website of Oulu Cloud computing services or utilizing Oulu Cloud computing services, it is also necessary to comply with the relevant laws and regulations of other countries and regions as well as international law.
(3) Engaging in the following activities without utilizing Oulu Cloud computing services:
- Entering computer information networks or using computer information network resources without permission;
- Deleting, modifying, or adding computer information network functions without permission;
- Deleting, modifying, or adding data and application programs stored, processed, or transmitted in computer information networks without permission;
- Deliberately making and spreading destructive programs such as computer virus;
- Other behaviors that endanger the security of computer information networks.
- Do not interfere with the services of Oulu Cloud computing services in any way.
- Comply with all other regulations and procedures of Oulu Cloud computing services.
- IP complaints/misuse operators will charge a fine of $20 per occurrence! (To be borne by the user)
Users are legally responsible for their actions during the use of Oulu Cloud computing services. Users understand that if Oulu Cloud computing service discovers that the information transmitted on its website clearly belongs to one of the contents listed in Article 1 of the previous paragraph, according to the laws of Hong Kong, China, and the country where the server is located, Oulu Cloud computing service is obligated to immediately stop transmission, save relevant records, report to relevant national authorities, and delete the address, directory, or shut down the server containing the content. If a user violates the provisions of OULU CLOUD [Acceptable Terms of Use AUP], OULU CLOUD has the right to directly delete all user data without providing any form of backup or compensation.
其他內容
- 本條款是在結合客戶權利及保證OULU CLOUD高效優質的產品和服務前提下製定的,對雙方均進行壹定的行為約束,以保證用戶的更多正當利益。OULU CLOUD有權對本條款進行適當調整。當服務條款發生變動時,將會在首頁及相關重要頁面上提示修改的內容,如果用戶不同意所改 動的內容,用戶可以主動取消所使用的網絡服務,如果用戶繼續使用,則視為接受服務條款的變動。
- 因OULU CLOUD上市,被收購、與第三方合並,名稱變更等事由,用戶同意OULU CLOUD可以將其權利和/或義務轉讓給新的所有者延續。
- 因本服務條款有關的壹切爭議,雙方應通過友好協商方式解決,如果協商未成,雙方同意向OULU CLOUD主要經營地所在的路易斯安那州法院提起訴訟解決。
